From [HERE] A federal appeals court on Wednesday blocked U.S. immigration officials from deporting a Mexican man who recently settled a lawsuit over claims that he was raped in a Montana jail while previously awaiting deportation proceedings.
Attorney Shahid Haque filed a petition with the 9th Circuit Court of Appeals on behalf of Audemio Orozco-Ramirez. The attorney said the temporary stay will remain in effect until the court issues a judgment.
Orozco-Ramirez was arrested Wednesday during a regular check-in with U.S. Immigration and Customs Enforcement, which had earlier allowed him to have a work permit, Haque said.
It's not unusual for immigrants who are in the country illegally to regularly report to immigration officials and not be deported, as long as they are considered a low priority.
That's changing under President Donald Trump, who used an executive order to broaden immigration officials' authority to deport people in the country illegally. The result has been more arrests during such check-ins.
"Ever since President Trump took office and he issued these new priorities, we've been seeing more and more that people who previously had been allowed to just check in and be free from detention, they've been arrested now," Haque said.
"The death penalty is a degrading proof of man’s inhumanity to man. It shows that man is still living in the barbarous age. Civilization still remains an idea – it has not become a reality." [MORE]
From [HERE] The state of Alabama took 30 years of Anthony Ray Hinton's life when they sent him to death row for two murders he did not commit.
Now they won’t give him a dime.
Hinton’s application for redress was unanimously approved by a state senate committee earlier this year and an Alabama lawmaker introduced a bill that would have set aside $1.5 million for what the 61-year-old Hinton calls "30 years of hell."
But the state legislature never got around to debating that bill before wrapping up its session in May, leaving Hinton bitter and practically broke two years after his convictions were tossed.
"I feel like I been raped the first time and now they’re raping me again," said Hinton. "I get tired of talking about race, but I have to call a spade a spade. They’re doing this to me because I’m a black man and they have the power. They’re doing this to me because they can."
Clay Redden, a spokesman for the Alabama State Legislature, confirmed Hinton’s compensation bill “never made it to the Senate floor.”
“It was approved 11 to nothing” by the state Committee on Compensation for Wrongful Incarceration, he said. “But that’s as far as it got. It was a rough session getting things passed.”
In addition to having a busy agenda, the legislature was wrapped up in the drama surrounding Gov. Robert Bentley, who was dubbed the “Love Gov” after he was accused of trying to cover up an adulterous affair with a former adviser. He resigned in April to avoid impeachment.
“We just ran out of time,” said State Sen. Paul Bussman, the Republican lawmaker who sponsored the bill to compensate Hinton.
But Alabama lawmakers did manage to pass the Fair Justice Act, which is designed to speed up executions by reducing the number of years death row inmates can appeal their sentences.

From [HERE] During the White House press briefing on Wednesday, White House senior policy adviser Stephen Miller went off on CNN’s Jim Acosta after Acosta pressed Miller about the racial implications of a new immigration bill backed by the Trump administration that gives English speakers preferred status.
Acosta, who mentioned that his father emigrated to the U.S. from Cuba in 1962 and obtained a Green Card, pointed out to Miller that “people who emigrate to this country — not through Ellis Island as your family may have but in others ways — do obtain a Green Card at some point, they do it through a lot of hard work, and yes, they may learn English as a second language later on in life, but this whole notion of, ‘Well, they have to learn English before they get to the United States’ — are we just going to bring in people from Great Britain and Australia?”
As Trump discussed during a separate press event earlier Wednesday, the so-called Reforming American Immigration for a Strong Economy (RAISE) Act would implement a “competitive application process” for aspiring immigrants that would favor English speakers.
“This competitive application process will favor applicants who can speak English, financially support themselves and their families, and demonstrate skills that will contribute to our economy,” Trump said. “The RAISE Act prevents new immigrants from collecting welfare and protects U.S. workers from being displaced. The two justices dismissed the claim as UK law does not recognize a crime of aggression:
The existence of such difficulties cannot in any way justify the domestic courts of England and Wales departing from the clear principle that it is for Parliament to make such conduct criminal under domestic law. Parliament deliberately chose not to do so. The courts cannot usurp that function. It is for Parliament and Parliament alone to make the decision. Furthermore, there is no answer to the practical and constitutional difficulties identified by Lord Bingham and Lord Hoffman that would arise if a prosecution was brought without clear statutory provision.
The matter was dismissed before it could be brought to the Supreme Court for judicial review, the High Court determining that the highest court in Britain would not break away from its ruling in R v. Jones [judgment].
This ruling comes at the end of a long line of investigations into the Iraq War [JURIST backgrounder]. From [HERE] Kansas Secretary of State Kris Kobach is seeking to avoid answering questions under oath about two documents containing plans for changes to U.S. election law.
Kobach, who is also vice chairman of Trump's Presidential Advisory Commission on Election Integrity, filed a notice late Monday saying he is appealing to the 10th U.S. Circuit Court of Appeals an order to submit to a deposition by the American Civil Liberties Union in a voting rights case. The closed deposition is scheduled for Thursday.
The ACLU told The Associated Press on Tuesday that Kobach's appeal of the deposition order to the 10th Circuit is "bizarre."
Two federal judges in Kansas have each twice ruled the Kansas Republican misled the court about the contents of documents he was photographed taking into a November meeting with then President-elect Donald Trump as well as a separate draft amendment to the National Voter Registration Act. Kobach was holding the document at his side with the print facing out so photographs made it possible to read part of what was written on it.
The court fined Kobach $1,000 and ordered him to testify about the documents.
The photographs prompted the ACLU to seek to obtain the document and any related materials on his proposed changes to federal voting law. Kobach essentially told the court and the ACLU that he didn't have any such documents — the misrepresentation the court cited in imposing sanctions against him.
His appeal to the 10th Circuit comes a week after U.S. District Judge Julie Robinson said Kobach has demonstrated a pattern of misleading the court about the facts and record in a voting rights case unfolding in Kansas.
The ACLU's lawsuit challenges a Kansas voter registration law that requires people to submit citizenship documents such as a birth certificate, naturalization papers or U.S. passport. An email cited in the case shows Kobach wants to amend federal law to make clear such proof-of-citizenship requirements are permitted.

From [HERE] and [HERE] The Michigan Court of Appeals heard arguments today in a lawsuit challenging Wayne County's tax foreclosures as disproportionately affecting minorities in some of Detroit's poorest neighborhoods, resulting in what some call "a government-created tax foreclosure crisis."
The lawsuit, filed on behalf of seven Detroit homeowners and a coalition of neighborhood associations in July 2016, argues that the Wayne County Tax Foreclosure process undermines the federal Fair Housing Act by disproportionately pushing people of color out of their homes. It was filed by the ACLU of Michigan, the NAACP Legal Defense and Education Fund and the law firm of Covington & Burling.
"Wayne County and Detroit are creating a human catastrophe by tossing thousands of homeowners into the streets for inability to pay unlawfully assessed taxes," said Michael J. Steinberg, legal director of the ACLU Michigan. "This short-sighted practice not only violates federal law, it destabilizes families, destroys neighborhoods and undermines the economic recovery of the region."

He explains that the flag is half composed of a Confederate symbol. Marylanders who supported the confederacy, many who fought along side General Robert E. Lee, adopted the Crossland banner.
He points out that the Crossland banner–the red-and-white flag-within-the-flag–was adopted by Marylanders who hoped to secede.
While the yellow-and-black flag represents Lord Baltimore, his Calvert family, and state solidarity, the red-and-white Crossland banner represented the opposition.
According to the Maryland Secretary of State’s website, the red-and-white Crossland design were seen as “secession colors” that were used to both resist the ideas of Lincoln and the Union.
“Maryland-born Confederate soldiers used both the red-and-white colors and the cross bottony design from the Crossland quadrants of the Calvert coat of arms as a unique way of identifying their place of birth,” the Secretary Of State notes, suggesting the merger of the two as a “reconciliation.”
Because of these Civil War ties, the flag has apparently been appropriated by white supremacists to subtly display racist points of view.

From [HERE] The Trump administration is preparing to redirect resources of the Justice Department’s civil rights division toward investigating and suing universities over affirmative action admissions policies deemed to discriminate against white applicants, according to a document obtained by The New York Times.
The document, an internal announcement to the civil rights division, seeks current lawyers interested in working for a new project on “investigations and possible litigation related to intentional race-based discrimination in college and university admissions.”
The announcement suggests that the project will be run out of the division’s front office, where the Trump administration’s political appointees work, rather than its Educational Opportunities Section, which is run by career civil servants and normally handles work involving schools and universities.
The document does not explicitly identify whom the Justice Department considers at risk of discrimination because of affirmative action admissions policies. But the phrasing it uses, “intentional race-based discrimination,” cuts to the heart of programs designed to bring more minorities to university campuses.
Supporters and critics of the project said it was clearly targeting admissions programs that can give members of generally disadvantaged groups, like black and Latino students, an edge over other applicants with comparable or higher test scores.

From [HERE] and [HERE] A federal court on Monday declined to order North Carolina to hold a special election before 2018 under new maps that do not pack black voters. Instead, the court simply ordered that new electoral maps be drawn by September 1.
In 2011, the North Carolina legislature redrew the boundaries of its election districts in a way that unconstitutionally harmed black voters. The legislature packed black voters into as few districts as possible, giving them less political influence. Since then, the illegally constituted legislature has passed a ban on local minimum wage increases, tax cuts for corporations, the notorious HB2 that limits civil rights protections for transgender people, and a 2013 voter suppression law that another court found targeted black voters “with almost surgical precision.”
Despite the damage done, a panel of three federal judges on Monday reversed a 2016 federal court order requiring special elections.
In August 2016, the U.S. District Court for the Middle District of North Carolina concluded that 28 legislative districts were racially gerrymandered. The court called for the maps to be redrawn and for North Carolina to hold a special election. The order noted that the costs of a special election “pale in comparison to the injury caused by allowing citizens to continue to be represented by legislators elected pursuant to a racial gerrymander.” North Carolina responded by taking the issue up with the Supreme Court.
In June of this year, the Supreme Court upheld rulings that North Carolina’s legislative and congressional districts were drawn in a way that discriminated against black voters. But it also argued that the trial court did not articulate enough reasons to justify a special election.
In just twenty years, the number of non-white voters has nearly doubled to a 4th of the electorate. And in the last election, the number of white voters actually fell by 2 million. [MORE]

From [HERE] As the Presidential Advisory Commission on Election Integrity renews its efforts to cull a trove of voter data from all 50 states, promising that no personally identifiable information would be exposed, its vice chairman, Kansas Secretary of State Kris Kobach, argued in a court filing against disclosing documents he was seen holding during a meeting with Donald Trump last November.
“The only information that will be made public are statistical conclusions drawn from the data, other general observations that may be drawn from the data, and any correspondence that you may send to the Commission” when responding to its questions, Kobach said in a letter to the states just a few days after a court cleared the way. “Let me be clear, the Commission will not release any personally identifiable information from voter registration records to the public."
With the exception of Arkansas, the states originally balked at proving the data requested by the commission, concerned that voter privacy would be compromised and that the information would be used to suppress votes.
The commission put its efforts on hold after the Electronic Privacy Information Center (EPIC), filed for a restraining order in a federal court in the District of Columbia, seeking to bar the commission from gathering data, prompting the commission to temporarily halt its efforts. But a judge denied the request saying EPIC hasn't proven harm. The American Civil Liberties Union (ACLU) has also filed a lawsuit against the commission, questioning the transparency of the commission chaired by Vice President Mike Pence.
