Three police officers accused of beating a man they thought had stolen a badge and wallet during an off-duty party pleaded not guilty to felony charges Wednesday after a court commissioner found there was enough evidence for them to stand trial. Frank L. Jude Jr., of Appleton, took the witness stand and for the first time formally faced the men charged with battering him while he lay face down in the street outside the house where off-duty officers were partying during the early morning hours of Oct. 24. Jude, 26, testified he could not identify the men who delivered the blows that left him with a fractured nose and other injuries. All three defendants, Jon Bartlett, Daniel Masarik and Andrew Spengler, are charged with party to substantial battery. Bartlett and Masarik also are charged with party to second-degree recklessly endangering safety. Masarik faces a third count of perjury. The only other witness at the preliminary hearing, Officer Joseph Schabel, testified he saw all three off-duty officers punch or kick Jude after Schabel and his partner responded to the scene. "Officer Bartlett came in and kicked Jude in the face," Schabel said, adding he heard a "popping and cracking" sound. Schabel said he ordered Bartlett to step back. Spengler "punched him twice in the face," and Masarik kicked Jude in the head, the officer testified. Commissioner Barry Phillips found probable cause to support the charges and set a scheduling hearing for early April.  [more]

There is no reason to have beaten a man that way, especially over a badge. The officers who chose not to speak up are equally as guilty. Someone whooped his ass. Frank, I hope you get all the money you deserve. God knows it was injustice to have a "one race" jury. I think it is in any case. Diversity is what the real world is filled with. That was definitely not the real world in that court room. This shit is ridiculous. God help us all!

Also, I like the way they casually say that he "was leaving the party when the beating took place." No he wasn't. He was uninvited to the party. He was found in the homeowners bedroom stealing his badge and wallet. There are several witnesses to this.He was fleeing a homeowner that he had just stolen from while carrying an official police badge. He tried to climb in a pickup (that his "friend" had already started and was waiting in the street) and all the off-duty cops, who are trained to notice suspicous activity and have each others back, tried to stop him. Were they drinking? Yeah. Was there a fight? Yeah. Did he get beaten? Yeah, but I would have done the same thing to someone who tried to walk out of your house during a party with your police badge and wallet. Frank Jude is NO victim. He is however, a convicted felon, a mother beater, a drug dealer and a thief. A LOW LIFE for lack of a better term. He deserves a beating at best for beating his mother. This was not a racial issue until the NAACP and local black leaders threw the race card again and made this a racial issue. The were other people of color at the party and these "racist" cops didn't have any problems with them. Just the opposite, everyone was having fun until this guy shows up uninvited, walks into some guys bedroom and steals his stuff. No justice has been served, this is what's called a travesty of justice.
