The injunction was put in place [JURIST report] by Judge Nelva Gonzales Ramos of the US District Court for the Southern District of Texas [official website] in late August after she found the revised law discriminatory against minority voters. Ramos had previously found that a 2011 law [SB 14 materials], which required voters to present a form of government-issued ID, discriminated [JURIST report] against blacks and Hispanics.
According to the appeals court:
The State has made a strong showing that it is likely to succeed on the merits. SB 5 allows voters without qualifying photo ID to cast regular ballots by executing a declaration that they face a reasonable impediment to obtaining qualifying photo ID. This declaration is made under the penalty of perjury. ... The State has made a strong showing that this reasonable-impediment procedure remedies plaintiffs' alleged harm and thus forecloses plaintiffs' injunctive relief. When this court remanded the case to the district court, the scope of the mandate only included the discretion to consider "any interim legislative action with respect to SB 14" in fashioning an "interim remedy for SB 14's discriminatory effect. By enjoining SB 5 from taking effect on January 1, 2018, the district court went beyond the scope of the mandate on remand.
The court also opined that the stay of the injunction will allow time for the case to proceed to the court on the merits. "A temporary stay here, while the court can consider argument on the merits, will minimize confusion among both voters and trained election officials."

My best judgment, having been involved in criminal law enforcement for many years, is that this is a dangerous, permanent trend that places the health and safety of the American people at risk.”
Preliminary analysis of crime data from the nation’s 30 largest cities released by the Brennan Center for Justice on Wednesday suggests that it isn’t. According to the center’s overview of crime and murder data, 2017 is on pace to have the second-lowest violent crime rate of any year since 1990.
The overall crime rate is projected to drop by 1.8 percent to the second-lowest point since 1990.
The violent crime rate is projected to fall by 0.6 percent, also to the second-lowest point in over 25 years. (The lowest rate was in 2014.) “This result,” the report’s authors write, “is driven primarily by stabilization in Chicago and declines in Washington, D.C., two large cities that experienced increases in violence in recent years.”

Leading up to Election Day, a majority (57%) of those who had voted or planned to vote said crime has gotten worse in this country since 2008. Holder Jr.’s Smart on Crime policy, the United States is gripped by a rising epidemic of violent crime that can only be cured by putting more drug offenders in jail for more time. Not only are violent crime rates still at historic lows but there is also no evidence that the increase in violent crime some cities have experienced is the result of drug offenders not serving enough time in prison. In fact, a recent study by the bipartisan U.S. Sentencing Commission found that drug defendants with shorter sentences were actually slightly less likely to commit crimes when released than those sentenced under older, more severe penalties. DACA Not Terminated Today But...Stay Tuned to Watch More Trump.From [The Intercept] SOME 800,000 PEOPLE brought to the United States as children without proper authorization had their lives thrown into limbo on Tuesday when the Trump administration said that it would eventually be ending a 4-year-old program that affords them legal protections.
“The program known as DACA, that was effectuated under the Obama administration, is being rescinded,” Attorney General Jeff Sessions told reporters, ending the program but implementing a six-month delay before protections are taken away.
The run-up to the announcement played out with the “will-he-or-won’t-he” formulaic drama of a reality TV show, only with real lives at stake. Trump used the suspense of whether the he would kick the “Dreamers” off the island to drive ratings. The move was both a fulfillment of a campaign pledge and a broken promise Trump made to DACA recipients because of the variety of public statements Trump has made on the issue.
On Sunday night, a news item in Politico sparked early public pushback to the yet-to-be-made announcement canceling the Obama administration’s Deferred Action for Childhood Arrivals program, which indefinitely put off deportation for young immigrants in the country without authorization. “Trump has decided to end the Obama-era program that grants work permits to undocumented immigrants who arrived in the country as children,” Politico reported.
The story, however, added: “In a nod to reservations held by many lawmakers, the White House plans to delay the enforcement of the president’s decision for six months, giving Congress a window to act, according to one White House official.”
It wasn’t just a nod to lawmakers, though — it was a nod to Trump himself, who has since the election repeatedly assured DACA recipients that they would be safe under his administration. And, despite Trump’s threats to the contrary, they may still be.
Trump’s base, riled up by two years of campaign rhetoric and presidential statements against immigrants, is thirsty for more enforcement actions. For DACA recipients and millions of their friends and family linked to their fates, it means that their fight is starting again, and much of the politics play to their advantage.

The news that Trump would end the program was first reported by POLITICO Sunday evening. The official announcement is expected Tuesday, although POLITICO’s sources acknowledge that it’s possible the president could change his mind.
In recent weeks, several Republicans have expressed support for DACA, and on Friday, Ryan, who has rarely opposed the president even when many in his own party have, implored the president not to end the program in an interview with a hometown radio station.
“I actually don’t think he should do that,” Ryan said when he was asked on a hometown radio show Friday about Trump ending the program. “I believe that this is something that Congress has to fix.”
In April, however, Trump said dreamers—the young immigrants who are protected by DACA—should “rest easy,” telling the AP that he was “not after the dreamers,” but “after the criminals.”

From [The Hill] A former top Republican strategist says the GOP “deserve[s] the reckoning that will eventually come” if President Trump ends the Deferred Action for Childhood Arrivals (DACA) program.
In an interview with BuzzFeed News, Sally Bradshaw, also a former top adviser to Florida Gov. Jeb Bush (R), said Trump is “anti-anything that would bring the country together.
“Donald Trump is anti-woman, anti-Hispanic, anti-black,” Bradshaw said. “The only thing he is for is for himself.”
Bradshaw was a co-author of the so-called “autopsy” commissioned by the Republican Party after their loss in the 2012 election. The GOP’s “Growth and Opportunity Project” recommended the party turn toward courting Hispanic voters and developing policies that would draw Hispanic voters to the GOP.
Bradshaw, who publicly left the Republican Party in 2016, accused GOP leaders of abandoning the recommendations from that report in their support of Trump.
“Those in Republican leadership who have enabled his behavior by standing silent or making excuses for him deserve the reckoning that will eventually come for the GOP,” Bradshaw told BuzzFeed News.

From [HERE] When the Justice Department issued a scathing report that detailed routine civil rights violations by the police and courts here after an officer fatally shot Michael Brown in 2014, one anecdote generated particular outrage.
A black man was sitting in his car in a Ferguson park when a police officer drew his gun on him. The officer searched the man’s car without permission and wrote him more than half a dozen tickets, including for lacking a vehicle inspection sticker and not wearing a seatbelt, even though the car was parked.
The episode, which occurred in 2012, helped spur the city to agree to criminal justice reform, and, along with the Brown case, prompted a federal consent decree with the Justice Department in 2016.
But five years after the arrest, Ferguson continues to prosecute the man, Fred Watson, even as it struggles to repair its image as a city that has been unfair, and at times hostile, toward African-Americans.
Mr. Watson is due in court on Tuesday for the start of a criminal trial for nine minor charges stemming from the episode.
“When does it stop?” Mr. Watson, who lost his job as a defense contractor after the arrest, said through tears during a recent interview. “This goes way beyond me. This practice has got to stop.”
The continued prosecution of Mr. Watson, 37, has raised questions among some residents about how serious Ferguson is about reform. The shooting death of Mr. Brown brought scrutiny not only on the frequency of police officers’ use of force against unarmed African-Americans, but also on Ferguson’s municipal court system and the practice, nationwide, of employing courts to bring in revenue through fines and fees.

Like concert promoters, the BLM are organizers [promoting justice] and most of the persons who attend the protests are unafiliated with the group.
Philadelphia Fraternal Order of Police President John McNesby made the statement Thursday during a rally held by and in support of police, according to NBC Philadelphia. The “Back the Blue” rally was in response to a protest the week before by members of Black Lives Matter held outside the house of Officer Ryan Pownall, who fatally shot David Jones in June.
Pownall, a 12-year veteran, shot Jones in the back as he fled from a traffic stop. Police said Jones was armed with a gun. This marks the second time Pownall has shot a black man in the back as he was fleeing. In 2010, he shot Carnell Williams-Carney who ran from cops while having an illegal gun on him.
“That was the day I took my last steps on my own,” Williams-Carney, the now 36-year-old shot by Pownall, told Philly.com from his wheelchair. “I’ve been in a chair ever since.”
“We will not let words stop us,” Khalif told the station. “The only words we’re using is justice for David Jones, and we will not be sidetracked by the bullying tactics of the FOP.”
The Pennsylvania Attorney General’s office is still investigating the fatal shooting.
While Philadelphia Mayor Jim Kenney called the tattoo “incredibly offensive,” McNesby had other thoughts.
“I’ve seen [the tattoo photo]. It’s an Eagle. Not a big deal,” he told Philly.com by text at the time. An internal affairs investigation later cleared Lichtermann of any wrongdoing, even as the mayor stood by his stance that the tattoo is “deeply offensive.”

From [HERE] During a preseason football game against the New York Giants last month, roughly a dozen players for the Cleveland Browns participated in a silent act of protest during the national anthem, joining the growing movement started by Colin Kaepernick to bring attention to police violence toward the black community.
Cleveland’s protest wasn’t the biggest or the flashiest, but it was notable because it marked the first time a white NFL player knelt during the anthem. Though some in Cleveland’s front office and on the coaching staff expressed their disagreement with the decision to protest, they supported their players’ right to express their opinions.
That sentiment was apparently not shared by the Cleveland police union. On Friday, Cleveland Police Patrolmen’s Association President Steve Loomis told Cleveland.com that his members would not participate in the flag ceremony scheduled for the Browns’ season opener on September 10.
Yes, Loomis is calling upon his members to boycott a national anthem ceremony as a form of protest against football players who are boycotting a national anthem ceremony as a form of protest.

According to a lawsuit [Complaint, PDF] challenging the constitutionality of Texas Senate Bill 4 (SB4) [text, PDF], the law violates [text, PDF] the First, Fourth, and Fourteenth Amendments. SB4 allows officers to question the immigration status of those arrested. It allows local police to subject perceived undocumented immigrants to enhanced interrogation based upon protected traits including race, ethnicity, national origin, and immigration status. The bill also subjects officials who refuse to cooperate with federal immigration agents to punishments such as criminal charges or removal from office.
MALDEF stated [press release] that the bill will increase racial profiling against Latinos and other minorities by subjecting them "to discriminatory stops and questioning by law enforcement officials who have no training and would not be subject to limits on when they question individuals about immigration status." Austin filed its own complaint to introduce its own specific claims, although its allegations are largely similar to those of the other cities—particularly San Antonio's. In May the cities of El Cenizo and El Paso [Complaints, PDF] filed suits hoping to halt the bill. Thomas A. If You are Still Attempting Moral Suasory on Racists then You Have Missed the Point! From [HERE] Several thousand religious leaders rallied next to the Martin Luther King Jr. Memorial in Washington on Monday and marched to the Department of Justice to protest both the Trump administration and displays of racism at the recent white supremacist rally in Charlottesville, Virginia.
Organizers dubbed the march, which coincided with the 54th anniversary of King’s March on Washington, “One Thousand Ministers March for Justice.” The Rev. Al Sharpton, the civil rights activist and liberal commentator who led the rally, said he had called for 1,000 leaders from various faiths to join him but that more than 3,000 registered.
In remarks before the group took to the street to march, Christian ministers, Jewish rabbis and other religious figures framed the event as a statement against white supremacy and a call for people of faith to combat racism and fight for social justice causes such as voting rights, criminal justice reform and health care access.
Sharpton, in a short speech before the march kicked off, declared the country in “moral trouble” and argued that faith leaders have an obligation to speak out.
Fear of Losing Control Over YOU. Today two white columnists for the NY Times, Abigail Levin and Lisa Guenther, asked hte following question in an ariticle called "White ‘Power’ and the Fear of Replacement,"
"When white nationalists converged in Charlottesville, Va., ostensibly to protest the removal of a statue of Robert E. Lee, they chanted, “You will not replace us,” and “Jews will not replace us.” But why were Jews a target of a neo-Confederate action, and who was the more generalized ‘you’?"
The photo above of a multi-racial family which appeared in Public News Service today clearly illustrates the answer. As articulated Dr. Frances Cress Welsing, most white people consciously or subconsciously understand the following;
White plus Black equals Colored.
White plus Brown equals Colored.
White plus Yellow equals Colored.
Answer = The "more generalized you" is all non-white people. That is what "you will not replace us" is about. The world is 90% non-white and growing. The "fear of replacement" fuels the system of white supremacy/racism and causes racists to act genocidally towards non-whites in a perceived "survival game" they are engaged in with us - in all areas of people activity.
White people are genetic recessive. In general, this means they cannot reproduce a white child when they have sexual relations with non-whites. The white "race" can be replaced or "genetically annihilated" through such assimilation or social intermingling with non-whites. As white populations have been consistently declining, Black and Brown populations are surging. And this scares racists to death. [MORE]
The chant "Jew will not replace us" refers to the fact that Jews were referred to in Germany and throughout Europe as Semites. Jews were not considered to be white people or aryans. As Semites they were considered to have their genetic roots amongst Africans - Black people on the continent of Africa.
Indeed, the word Semite is derived from the Latin prefix "semi," which means half. Semites were the products of the genetic mixture produced when white Greek and Roman soldiers invaded Africa and raped African women, who of course were Black. Semite means the same as mulatto. Thus they were considered to be half Black and half white, or colored people. Thus, a yellow colored star was placed on their outer clothing by the German government in the Hitler era [otherwise they could not tell them apart from non-Jew Germans - in this system of racism/white supremacy there is no need for any such star - non-whites are targeted by skin color [MORE]
The terms anti-Semite and anti-Semitism most fundamentally refer to a destructive ideological, psychological and behavioral state of "anti-color" waged by people who classify themselves as white against those who are classified as non-white, even when those non-whites have lost much of their skin coloration in some instances.

The Absence of Skin Color is the Only Criteria. From [HERE] San Diego’s Border Patrol chief says his agents don’t use race or ethnicity as the basis for their immigration enforcement – but he also won’t say what his agents do look for to determine whether someone is involved in criminal activity.
Even if Border Patrol agents are profiling people based on race, they might not be breaking the law. The U.S. Border Patrol is one of the few agencies that’s legally allowed to use race as a reason to stop drivers or question people on the street, so long as agents see indications of criminal activity or immigration violations.
When then-attorney General Eric Holder rolled out new guidelines in 2014 restricting law enforcement agencies from considering race or ethnicity when enforcing federal law, the administration exempted several agencies, including Border Patrol, from the new rules. If imposed, the agency successfully argued at the time, the rules would prevent agents from effectively doing their jobs.
Still, San Diego Border Patrol Chief Richard Barlow told Voice of San Diego in an interview, this isn’t how his agents operate.
“We are looking for articulable facts that link folks to smuggling activities or criminal activities, in the simplest terms. That’s the main focus – what that person is doing that raises the level of suspicion, along with a whole bunch of other factors,” Barlow said.
He declined to give examples of the signs agents look for, because to do so would divulge law enforcement techniques that may jeopardize the agency’s mission, he said. [white supremacy/racism is carried out through deception and/or violence.]
That lack of clarity concerns the ACLU and others who worry people’s civil liberties are constantly at risk.
“The longer Border Patrol can avoid articulating with any precision how they operate, the longer people’s constitutional rights are at risk of being violated. Because if they can’t articulate the limits of their authority they can effectively do whatever they want,” said Mitra Ebadolahi, Border Litigation Project staff attorney for the ACLU of San Diego and Imperial Counties.
The agency’s reach nationwide extends 100 miles from all U.S. borders, including the coastline. That includes roughly 200 million people, or two-thirds of country’s population.
A chief concern for civil liberty advocates is the lack of clarity on the limits to Border Patrol’s authority within its boundaries, where they already have extra-constitutional powers to enforce immigration law.
Within 100 miles of the border, for example, Border Patrol can set up immigration checkpoints, where agents can question a vehicle’s occupants about their citizenship and place of birth. They can and ask to see proof of immigration status, how legal status was obtained and make quick observations of what is in vehicle.
The new law automatically registers Illinois residents to vote when they sign up for or renew a driver’s license or state identification — unless they choose to opt out. The old law asks Illinois residents whether they want to register, which voting rights advocates say is less effective.
The measure "will remove a barrier to voter participation by modernizing the voter registration process to make it simpler and more convenient for Illinoisans to vote," Rauner said. "It’s my hope that this will increase voter participation so constituents’ voices are heard."
The new law is expected to add 2 million people to the rolls of voters, supporters said.
The measure was passed unanimously by the Illinois House and Senate.
