Psychopathic White Man charged with Milwaukee Murder of Unarmed 13-year-old Black Boy Claims Incompetence to Stand Trial

Do Not Expect Justice - Expect White Supremacy Racist Suspect John Spooner is accused of murdering Darius Simmons, an unarmed Black 13 year old in front of his mother in an unprovoked shooting in the front of her home on May 31 in Milwaukee. After the murder, even though Spooner confessed to the murder, the Milwaukee police searched the mother's home, detained her for hours and arrested her other son. Trial Delayed. From [HERE] A 76-year-old white man accused of shooting and killing his Black teenage neighbor will get a mental exam to determine whether he's competent to proceed to trial. John Spooner was in court Monday for a motion hearing. He's accused of killing 13-year-old Darius Simmons, who was unarmed and did not provoke or otherwise threaten Spooner.

Defense attorney Steve McGaver requested a change of venue, arguing that pre-trial publicity would make it difficult for Spooner to receive a fair trial. Judge Jeffrey Wagner denied that motion. McGaver also told the judge there was reason to believe Spooner might not be competent to proceed. The judge ordered that Spooner be evaluated by a mental-health professional. Online court records say the doctor's report is due Feb. 4. The trial date was also pushed back two months, to May 6.

According to the criminal complaint, Simmons was retrieving the garbage from the curb when he was confronted by Spooner. Spooner, the victim of multiple burglaries, claimed Simmons was the culprit of at least one of the burglaries.

Spooner asked Simmons for his belongings back, including two shotguns. Simmons denied having anything to do with Spooners’ stolen property. During the confrontation Simmons’ mother Patricia Larry told police that she also told Spooner that her son had nothing to do with his stolen property.

The criminal complaint says that’s when Spooner pulled out his gun and fired two shots at Simmons' chest. The boy ran around the corner and collapsed, and Spooner waited for police to arrive. When police arrived Spooner said, “Yeah I shot him.” [MORE] In other words this allegedly was a pre-medidtated murder of an unarmed Black child. That is, Spooner 1) went and got his gun 2) loaded it, 3) confronted Simmons 4) made decision to kill 5) shot him two times as his mother watched (no concern for consequences), 6) calmly waited for police, 7) confessed to police and 8) made up story about a theft.  

Advocacy groups contend the shooting was racially motivated and asked that Spooner also be charged with a hate crime.

A competency evaluation can be demanded by ANY defendant as a matter of right. The judge isn't ordering the evaluation as some sort of favor for whitey. Also, none of the italicized elements you outline (premeditation, etc.) would be inconsistent with an adjudication of incompetence.
