A federal judge has thrown
out most of a two-year-old lawsuit accusing the Alabaster Police
Department of racial profiling. U.S. District Judge Sharon Blackburn
dismissed claims against the department, the city and unidentified
officers who were accused of stopping blacks and Hispanics solely
because of their race. Blackburn did not dismiss the claim that alleged
profiling was the result of the policies set by Chief Stanley Oliver
and ex-chief Larry Rollan. But the judge left open the opportunity for
the city to ask that claim also be dismissed against Oliver and Rollan
based on qualified immunity. The judge noted in her order she had
reservations about not throwing out those claims now. Qualified
immunity typically applies to public officials when performing their
jobs. [more ]
