The Louisville Metro Police Department has struck a deal that will ensure former Officer McKenzie Mattingly won't ever be back on the police force. The family of the drug suspect he shot to death says they're shocked and upset by the deal. In January 2004 Mattingly shot 19-year old Michael Newby. Metro Police said the shooting occurred during an undercover drug bust gone bad. Mattingly was later fired but a jury acquitted him on murder charges. He petitioned to get his job back. Now he has apparently struck a deal with the LMPD in which he'll receive about $60,000 in back pay and will stop trying to be reinstated as an officer. Newby's family is upset because they didn't even know the deal was being negotiated. Newby's mother, Angela Bouggess said, "When it came to this thing right here, we didn't have no idea any of this was going on, then bam! Smack in the settlement he's getting $60,000." LMPD chief Robert White said, "From my perspective what's the most important thing is McKenzie Mattingly is not a police officer in our department and that goal was met today." [more]

Newby's family rejects offer to settle lawsuit against city

Louisville metro government has offered to settle a $5 million wrongful-death lawsuit filed by the family of Michael Newby, the 19-year-old man shot by former police Detective McKenzie Mattingly during an undercover drug deal in January 2004. The civil suit was filed against Mattingly and the metro government last March. Newby's family said last night that the city had offered them $200,000, a figure that city officials confirmed. The family rejected that offer, said spokesman Christopher 2X. Mayor Jerry Abramson said yesterday that both sides have agreed to send the matter to mediation. "We'll see what happens now," 2X said. You really should get the facts straight. Michael Newby was armed with a .45 cal. auto when he was shot. He attempted to disarm the detective during a violent struggle ion which Mattingly’s pistol discharged. Newby was a drug dealing street punk that happened to be black; he'd be just as dead if he'd been white, green or purple. Mattingly was indicted because in Louisville Kentucky the chief prosecutor, Commonwealth’s Attorney Dave Stengel (a Democrat) is pandering to the black community to get their vote. Stengel realizes he will need those votes (probably many more) to have a chance at reelection. Just as I predicted the Mattingly not guilty verdict, I’m predicting Stengel loses the next election, that is if he has the nads to run.. Stengel has lost the support of the Metro Police Dept. as well as the trust of the community. He’s done in this town. Due to the inane indictment of Mattingly this community was put through a kangaroo trial and everybody in the community knew a conviction wasn’t possible. By law, a officer still can defend himself against deadly force; that’s all Mattingly did. Now Dave "I have dynamite here" Stengel is the laughing stock of the community and is probably begging the Attorney General to give him a job.

Yes once again, there is a though to voice you thoughts on the once again drug dealing black man whom was shot duringa drug deal going bad, but yet we are talking about a black person shot not arrested to stand trial and the position of the people was if there was drug sting and yes we have seen much of these stings go down on the show ( COPS ) WHERE WAS THE BACK UP AND ALL THE RISK FATORS, TO BRING THE DRUG DEALER TO JUSTICE. So what i am saying is this for the matter is that the person in question that was shot, was not an alien, but a black male, and yes one has the right to defend him self but for the outof line and the unsupervised police uncover sting gone wrong whom is accountable. why was a struggle , why was the drug dealer not subdued by back up, why was there no taser? Why was this police office allowed not to work for your state but can seek employement else where, and why was he paid back pay in such a mannner to make it seem that yes we are trying to solve the issue but still we are ignorant and not respectful of the family, I am not saying drug dealers have rights but yet court of laws have the right to give anyone a trial that breaks the law lets get them into courts and lets get supervised drug deals and sting operations that dont embarrese and disgrace, local law emforcament for that man has give you a two black eyes and a busted lip. Newby was a black man. So what, he'd be just as dead if he'd a been white. You seem to gloss over the fact that Newby was packing a .45 cal. auto and that Newby tried to disarm Officer Mattingly during a struggle. Obviously you've never been involved in a police drug sting. You can plan all you want but you never know the intentions or opr to what extent a drug dealer will go to avoid capture. The fact that Newby was carrying a pistol tells me he didn't intend to go to jail. He wasn't hunting rabbits with the thing. Mattingly was paid $60,000, not nearly enough for what the cowardly Commonwealth Attorney Dave Stengel put him through. You have your info wron. Mattingly can work anywhere he likes in Kentucky or anywhere else. He agreed not to seek employment with the Louisville Metro Police Dept. If I were Mattingly I'd reapply and then sue when the adminstration didn't hire me. Newby was a piece of crap his family had little use for until the vision of dollar signs appeared in their dreams. The only loss the community suffered because of this incident was losing a good police officer. Hopefully Stengels (I think) illegal actions will cost him the next election. I personally think he's an alcohol powered cowardly political hack that deserves the scorn of the community.

First of all, you're a complete idiot. Why are you typing in ebonics? You live in Louisville, not Oakland. I don't have any opinions on this case because I don't really know the facts but I will say that if the kid had a gun and intended to use it (whether he was BLACK OR NOT) then the officer had a right to defend himself (whether he was WHITE OR NOT). Race isn't the issue here... self-defense is. If you want to call someone a racist than you'd better have facts to prove it.
