Too Much "Routine," not Enough 4th Amendment. As pointed out by the Supreme Court, "total compliance with traffic and safety rules is nearly impossible, a police officer will almost invariably be able to catch any given motorist in a technical violation. This creates the temptation to use traffic stops as a means of investigating other law violations, as to which no probable cause or even articulable suspicion exists." [MORE] Since the 1980's police departments have co-opted local traffic codes as a major weapon of racism/white supremacy to be used against Black & Brown travellers.
For white folks, the bare essentials of a "routine traffic stop" consist of causing the vehicle to stop, explaining to the driver the reason for the stop, questioning solely based on the stop, verifying the credentials of the driver and the vehicle, and then issuing a citation or a warning. 10 minutes later, have a nice day buddy.
For many Non-whites, particularly Latinos and Blacks, the bare essentials of a traffic stop consist of a records check via radio or computer regarding the criminal & traffic history of those stopped and any outstanding arrest warrants for those individuals; papers check for citizenship status of driver and passengers, records check of the vehicle registration, [questioning unrelated to the stop such as] interrogation of those stopped directly on the subject of immigration status, drugs or weapons, interrogation about the nature and purpose of their travels; seeking (and often obtaining) consent to conduct a full search of the stopped vehicle and the driver/passengers; using a drug-sniffing dog to detect the presence of any drugs in the stopped vehicle and/or verbal abuse, provocation, physical beat down, prolonged detention and/or deportation. "They're Taking Everybody." From [HERE] IN TEXAS, STATE troopers have become frontline enforcers of federal immigration laws. In recent years, and especially since Donald Trump was elected president, the Texas Highway Patrol, part of the state’s Department of Public Safety, or DPS, has developed a well-oiled deportation machine that scoops up drivers who’ve committed minor traffic infractions, then funnels them to the Border Patrol and sometimes Immigration and Customs Enforcement. Passengers and pedestrians who weren’t even driving are also taken into custody. Caught in the Texas deportation pipeline, immigrants’ lives are damaged or ruined, along with those of their children, many of whom were born and raised in the U.S.
It’s difficult to know exactly how often this is happening. DPS records are costly, hard to obtain, and difficult to interpret. Data on handovers was not collected until December 2015, and since then the reporting of these incidents has been haphazard. In 2017, troopers still were not consistently reporting all stops that resulted in handovers to the Border Patrol. Through public records requests, the ACLU of Texas determined that the agency’s internal documentation did not record the handovers of several individuals who the organization’s field organizers knew had been detained by the highway patrol, imprisoned, and, in some cases, removed from the country.
Subsequently, The Intercept, working with the ACLU of Texas, obtained several DPS dashcam videos that show immigrants being detained on the road for trivial violations and then carted away by the Border Patrol.
The details of these deportations were gathered initially from DPS paperwork and dashcam videos, obtained through open records requests. We then located the detainees and their families, including in Mexico. We made house visits and played the videotapes. As they watched, parents and children talked about how their lives were upended by Texas state troopers and current state and national immigration policy.
From [HERE] Just past 10 p.m. on a summer night, attorney Cheryl Wattley is standing near a quiet street in West Dallas, reconstructing an old crime.
It's a moonless night. One street light and one porch light from a nearby house illumine the scene, nearly identical conditions to the night 30 years ago, when a young man was left to die on the street not too far from here.
Wattley points toward a man standing under the street light, a private investigator named Daryl Parker, as he positions himself in the alley 40 feet away.
"Can you identify him?" she asks.
I squint. It's nearly impossible to see anything.
"You see a silhouette of a man," Wattley says. "You can't even see his face."
On the night of the killing, witnesses said they could see more than a silhouette. They identified Benjamine Spencer and another man running away from the scene. Their testimony helped send them to prison.
But was Spencer guilty? He maintains his innocence. A trial judge even declared Spencer innocent and concluded the evidence that put him behind bars was falling apart. That was 10 years ago. A higher court ruled that was not enough to warrant a new trial. And Spencer remains in a maximum security prison.
This is how he got there.
On March 22, 1987, 33-year-old Jeffrey Young, the acting president of a clothing manufacturing company called FWI, was robbed as he was leaving his office around 9:30 p.m. in a warehouse district of Dallas. Police say two attackers robbed and beat him. They stuffed him in his BMW, drove over the Trinity River to West Dallas, dumped his body on the street, abandoned his car in the alley and fled.
Police got lucky: Three witnesses said they knew the two men from the neighborhood. They identified Spencer and Robert Mitchell as the men who abandoned the car.
"These are not eyewitnesses who were strangers — strangers who all of the sudden had to pick somebody out of a lineup," says Faith Johnson, the current district attorney in Dallas County. "These people knewSpencer."
Four days after the crime, police arrested Spencer. He was 22 years old, newly married, and expecting his first child. He'd had brushes with the law. He'd spent a few days in jail for driving on a suspended license. He'd received six years of probation for driving a car stolen by a friend.
He thought his arrest was a simple mistake, soon to be rectified.
Spencer had an alibi. He and a young woman told police they hung out from around 7:30 p.m. to past midnight the night of the killing. There was no physical evidence connecting him to the crime — no fingerprints, no murder weapon, and no Seiko watch, wedding ring, briefcase or portable TV — items that were taken in the robbery.
"I began to think, 'Well, I didn't commit this offense, the truth is going to come out,'" he said.
What can we learn from this video? The racist suspect driver probably could not get away with this if the Kentucky cop was white. A non-white driver could never get away with this with any white or Black cop in a system of racism/white supremacy.
1) Blacks with Authority Cannot Mistreat Whites in a White Over Black System of Unequal Power. As we know it is rare for a white police officer to be punished for using excessive force against a black man, woman, or child. Anon explains, "it is just as rare for a black police officer to use excessive force against a white person."
'In fact, researchers for Anon were unable to find a single instance of a black police officer shooting or killing an unarmed white person in the history of modern law enforcement. This is not surprising but it is absolute proof that the black individual operating within a system of white supremacy cannot mistreat whites even if he or she is wearing a uniform, a badge, and carrying a gun.' A black person whose power comes from a white institution will not be allowed to mistreat whites -unless he or she is following orders from more powerful whites. In a system of white supremacy, all whites are more powerful than blacks.
A white supremacy system by its very NATURE forbids ALL non-white people - regardless of wealth, status, or position - from victimizing white people.
Powerful blacks present no danger to the white collective but they can be extremely dangerous to other blacks. They are often rewarded for victimizing black people (doing the dirty work), and are usually following orders from more powerful whites behind the scenes." [MORE]
In the video above, the Black cop seems confused after he is confronted, acting like a child trying to tell his parents what to do.
2) No Rules or Code For Dealing with Cops. It is clear from the video that there can be no rules or codes to robotically apply when dealing with the police. You cannot always comply and you cannot always be polite. Will you comply with a maniac cop while he is beating your woman or mother on the side of the road? Will you robotically comply with them when you have a good reason to believe that you will be killed? What are you living for?
Reasonable cops look just like maniac cops until they start talking. There can be no set plans for dealing with a maniac. It is like making a set of plans to prepare for falling out of a tree or falling down the steps. [MORE]
The problem is not compliance. It is robotic, automatic, "always" compliance - having some set pre-made plan or code and script ready to go. Its not that guides or rules are never useful. They may be but there can be no robotic application of them. Following a script, reciting magic legal phrases or words memorized from a code is a sure way to get killed by cops. You are missing the present moment of what is going on right now, right in front of you. Each circumstance is different, "you cannot step in the same river twice" - it is stupid to pretend otherwise. The only rule is be alert, witness your mind and what is going on right now in front of you. As explained by Osho Rajineesh, "No man of understanding can follow rules strictly. 3) Belief in Authority is Dangerous. The racist suspect in the video demonstrates an excellent point about the nature of authority. What exactly is it and why do we consent to it? Endeavoring to undeceive Doc Blynd explains the following in FUNKTIONARY:

Only you have authority over your Self...anything else. i.e.. to accept any authority external to one's Self once of discriminating age, is the very definition of irresponsibility. There are now 7,600 new electronic eyes out there, paid for by the D.C. surveillance camera rebate program. [what will all the bored criminals do now?? The police are referring to private cameras owned by citizen and businesses that were added to a network of police, public works, Metro bus and subway and Homeland security cameras to enable voyeuristic Government rulers [sevants] to watch Latinos & Black folks go back and forth.]

"I cannot tell you how valuable it has been for us on the Metropolitan Police Department to have these cameras capturing suspects involved in this type of behavior," says Chief Newsham. Mayor Bowser says she believes the city is the safest it's ever been in her lifetime. But she knows even one robbery is too many, like the one that ended Zaire Kelly's life. In fact, according to the center’s overview of crime and murder data, in 2017, D.C. is on pace to have the second-lowest violent crime rate of any year since 1990.
The overall crime rate is projected to drop by 1.8 percent to the second-lowest point since 1990.
The violent crime rate is projected to fall by 0.6 percent, also to the second-lowest point in over 25 years.
The murder rate is projected to be down 2.5 percent, on-par with the rate in 2009

What is clear from the above data is that people are obeying the law. In fact, in contrast to pervious times, such as the 1960's, 1970's and 1980's, obedience to authority is at record levels. In recent years, as high rates of maternal mortality in the U.S. have alarmed researchers, one statistic has been especially concerning. According to the CDC, black mothers in the U.S. die at three to four times the rate of white mothers, one of the widest of all racial disparities in women's health. Put another way, a black woman is 22 percent more likely to die from heart disease than a white woman, 71 percent more likely to perish from cervical cancer, but 300 percent more likely to die from pregnancy- or childbirth-related causes. In a national study of five medical complications that are common causes of maternal death and injury, black women were two to three times more likely to die than white women who had the same condition.
That imbalance has persisted for decades, and in some places, it continues to grow. In New York City, for example, black mothers are 12 times more likely to die than white mothers, according to the most recent data; in 2001-2005, their risk of death was seven times higher. Researchers say that widening gap reflects a dramatic improvement for white women but not for blacks.
The disproportionate toll on African-Americans is the main reason the U.S. maternal mortality rate is so much higher than that of other affluent countries. Black expectant and new mothers in the U.S. die at about the same rate as women in countries such as Mexico and Uzbekistan, the World Health Organization estimates.
What's more, even relatively well-off black women like Shalon Irving die and nearly die at higher rates than whites. Again, New York City offers a startling example: A 2016 analysis of five years of data found that black, college-educated mothers who gave birth in local hospitals were more likely to suffer severe complications of pregnancy or childbirth than white women who never graduated from high school.
The fact that someone with Shalon's social and economic advantages is at higher risk highlights how profound the inequities really are, said Raegan McDonald-Mosley, the chief medical director for Planned Parenthood Federation of America, who met her in graduate school at Johns Hopkins University and was one of her closest friends. "It tells you that you can't educate your way out of this problem. You can't health care-access your way out of this problem. The event was saddled with controversy that the organizers did not anticipate nor desire, as the president, distrusted by many black leaders, prompted prominent civil rights figures to boycott the opening ceremonies.
Trump read from what appeared to be a prepared speech at a podium in an event space in the museum.
“The civil rights museum records the oppression and injustice inflicted on the African-American community, the fight to end slavery, to break down Jim Crow, to end segregation, to gain the right to vote, to achieve the sacred birthrights of equality here,” Trump said in the speech. There was some applause, and Trump looked up from his podium, appearing to comment on what he had just read.
“That is big stuff, that is big stuff — very big phrases, very big words,” he said, assumedly referring to the thematic breadth of ideals like equality, since “equality” is not a relatively long word. “Here we memorialize great men and women who struggled to sacrifice and sacrifice so much so that others might live in freedom.” [LOL]

Clinton won the national popular vote by at least 2.9 million, despite a massive Jim Crow vote-stripping fraud perpetrated by GOP governors and secretaries of state in about 30 states. Parallel to ChoicePoint in Florida 2000, they used a program called Interstate Crosscheck, spread by Kansas Secretary of State Kris Kobach. As reported by Greg Palast, Crosscheck stripped voter rolls on the pretext that citizens were double-registered, even if their names did not match from one state to the other.
Palast estimates that at least 1 million voters were denied their ballots in this way, most of them likely Clinton voters who were black, Hispanic, Asian-American, Muslim and young. As featured in Palast’s book and movie “The Best Democracy Money Can Buy,” Kobach chairs the White House commission aimed at stripping registration rolls in upcoming elections.
Clinton won the exit polls in Florida, North Carolina, Pennsylvania, Michigan and Wisconsin—more than enough to give her an Electoral College victory. In all those states, the official vote count was deeply tainted with massive registration stripping and widespread electronic flipping. Trump’s total alleged margin in Wisconsin, Michigan and Pennsylvania was under 100,000. As Palast has reported, more than enough Wisconsin voters were stripped from the registration rolls using new photo ID requirements to flip that key state to Clinton.
In Michigan, where Clinton allegedly lost by about 10,000 votes, some 70,000 ballots were recorded without a presidential preference. In the face of obvious manipulation, stupid Dems, sleepy Blacks and the corporate media have never questioned the absurd presumption that tens of thousands of Democratic voters in Detroit and Flint would slog through long lines and official abuse to cast ballots without marking a choice for chief executive. In 2016 GOP built and put into action a voter erasing system called Interstate Crosscheck. Crosscheck along with thousands of votes intentionally not counted in Black voting areas, such as Flint & Detroit chose the president and determined who controls Congress.' [MORE]
Palast's undisputed findings reveal that millions of Black, Latino & Asian voters were removed from voter rolls in swing states by Interstate Crosscheck, a so-called "voter fraud" program created by the GOP. Thirty (30) states participate in Interstate Crosscheck. Palast calls Crosscheck the "Great White Hope Machine." In Novmeber, professors from Harvard and Stanford confirm Palast's findings of massive vote thievar using Interstate Crosscheck. [MORE]
Interstate Crosscheck removed voters from the voter list if a voter's name appeared to be registered in more than one state. Around 7 million names were put on the list of “potential double voters” before the 2014 election. The Crosscheck program then compares each state’s list with lists from other states in the program. Specifically, according to Palast, the Crosscheck list contains 7,264,422 voters.
Although the Crosscheck program aims to prevent individuals from voting in more than one state in the same election, Crosscheck has been doing the exact opposite and is used to remove legitmate voters from voting rolls. Greg Palast has claimed that before a single vote was even cast, the election was already fixed by Trump operatives who eliminated millions of legitimate African American, Latino and Asian voters from the voter rolls in North Carolina, Ohio, Wisconsin, Michigan and Pennsylvania. This is typical of the Crosscheck "suspects." Above the list allegedly indicates that James Elmer Barnes Jr. of the state of Georgia voted a second time in Arlington, Virginia as James CROSS Barnes III.
Yet, the only evidence that these two names represent the same person one is that the first and last names match - nothing else matches and no information such as social security number, age, height, weight etc exists or was applied. In other words, without more there is no evidence of voter fraud here. But their absentee ballots will never be counted.
Look at the second "double voter": James Ratcliffe Barnes Jr. of Georgia is accused of voting a second time in the state of Virginia—even though the second voter has a different middle name (Anthony) and has no suffix added to his name.
While state government officials could not locate Mr. Barnes, the alleged double-voting criminal to arrest him, Palast had no trouble locating him. Mr. James Elmer Barnes Jr. told said he had never used the middle name "Cross," never been "III" (the "Third"), and never been to the state of Virginia, let alone voted there.
Georgia and Virginia officials wouldn't explain why these clearly different Mr. Barnes were still on the suspect list. Indeed, the Republican officials wouldn't talk to Palast at all.
Neither state arrested a Mr. Barnes for voting twice (that is, they did not arrest James Elmer Barnes Jr. nor James Cross Barnes, who are in fact two very different people). Rather, both states prepared to remove them from the voter rolls. Both Messrs. Barnes are about to lose their right to vote, that is, be removed from voter rolls.
How odd. If you rob a bank and get caught, the police don't close your bank account. They arrest you and send you to prison. Here, Mr. Barnes is accused of a crime punished the same as robbery, yet he is not arrested.
And that's because Mr. Barnes is innocent—both Mr. Barneses are innocent. Clearly. But, without a trial— indeed, without their even knowing it—both men could lose their right to vote.
Now, take a look at the longer list of suspects above. Everyone is named James Brown. That is, for example, James S. Brown is supposed to be the same voter as James Howe Brown Jr.
What is the evidence? Only that each voter has the first name "James" and the surname "Brown." Like the late soul singer.
According to Palast there are 27,456 people in the USA named James Brown. According to Crosscheck, they must be a criminally minded family. According to Crosscheck, thousands of people named James Brown are vorting twice. [MORE]
The inherent racial bias in the Crosscheck database results in an astonishing one in six Hispanics, one in seven Asian-Americans and one in nine African-Americans landing on what Palast dubs “Trump’s hit list.” His investigators calculated 1.1 million non-white people, many spread over crucial swing states were deprived of their right to vote on election day.

Dozens more were reported wounded in clashes in the West Bank and Gaza Strip. The ministry said that Mohammed Al-Masri died after being struck by live fire east of Khan Younis in the southern Gaza Strip, and that more than 35 Palestinians were injured, two seriously.
It was the first death since clashes erupted across the Palestinian territories after President Donald Trump recognised Jerusalem as Israel's capital. The Israeli military said in a statement that during clashes along the border fence soldiers "fired selectively at two main instigators" and confirmed hitting them.

Hurricane Maria pummeled Puerto Rico with great fury but the government there has reported an official death toll far lower than the devastation suggests.
A review by The New York Times of daily mortality data from Puerto Rico’s vital statistics bureau indicates a significantly higher death toll after the hurricane than the government there has acknowledged.
The Times’s analysis found that in the 42 days after Hurricane Maria made landfall on Sept. 20 as a Category 4 storm, 1,052 more people than usual died across the island. The analysis compared the number of deaths for each day in 2017 with the average of the number of deaths for the same days in 2015 and 2016.

After Hurricane Maria destroyed the town’s bridge in San Lorenzo, Morovis, P.R., family members were trying to get Rosa Maria Torres, 95, airlifted out of the town. “If they don't move her out of here, she’s going to die,” said Carmen Santos, Ms. Torres’s granddaughter.
Officially, just 62 people died as a result of the storm that ravaged the island with nearly 150-mile-an-hour winds, cutting off power to 3.4 million Puerto Ricans. The last four fatalities were added to the death toll on Dec. 2.
“Before the hurricane, I had an average of 82 deaths daily. That changes from Sept. 20 to 30th. Now I have an average of 118 deaths daily,” Wanda Llovet, the director of the Demographic Registry in Puerto Rico, said in a mid-November interview. Since then, she said on Thursday, both figures have increased by one.
Data for October are not yet complete, and the number of deaths recorded in that month is expected to rise. Record-keeping has been delayed because Puerto Rico’s power grid is operating at less than 70 percent of its capacity and swaths of the island still do not have power.
The deadliest day was Sept. 25, the day the governor of Puerto Rico, Ricardo A. Rosselló, warned that a looming humanitarian crisis could prompt a mass exodus from the island.
President Trump responded that night by taking to Twitter to say the island had to deal with its massive debt: “Food, water and medical are top priorities - and doing well. #FEMA.”
It was over 90 degrees, and power was out on most of the island, even in most hospitals. Bedridden people were having trouble getting medical treatment, and dialysis clinics were operating with generators and limiting treatment hours. People on respirators lacked electricity to power the machines.
On that day, 135 people died in Puerto Rico. By comparison, 75 people died on that day in 2016 and 60 died in 2015.
One local mayor went to the Federal Emergency Management Agency command post that day and shouted for help. Statistics show his city, Manatí, had among the highest mortality rates in September.
With communications down throughout the island and bodies piling up in hospital morgues, the government was still clinging to its early death count estimate of 16.
On Sept. 29, Héctor M. Pesquera, Puerto Rico’s public safety secretary, said in an interview that the death count would not swell by much.
“Will it go up? I am pretty sure it will go up,” he said. “It won’t double or triple. It’s not like an earthquake where you have a building and you don’t know whether there were 20 in the building or 300 in the building until you get all the rubble out.”
The day he said that, 127 people died, 57 more than the year before.

A St. Paul police dog clamped down on 52-year-old Desiree Collins’ arm in September.
Officers claim they had been trying to catch two burglars in a nearby break-in the Frogtown neighborhood, which is 65% non-white. However, the entire video does not reveal any hot pursuit. Two white cops are seen almost casually walking down a sunlit alley in early morning with their dog leading the way on a 20-30 feet, loose leesh. Given the length of the leash, what happened was clearly forseeable to a reasonable person.
Collins suffered bites to her arm and leg. Desiree Collins is still recovering from her injuries from that Saturday morning attack by a St. Paul Police dog.
“You see the whole thing unfold. You see the terror on her face. You see clearly it taking the officers too long to get that dog off of her,” Noel said. In the video, one white cop simply stands nearby her arm and the dog attack - just watching, as if to say 'helping Black people is not what I signed up for.'
Collins, understandably, is suing the city and the police department. Andrew Noel, one of her attorneys said:
The entire incident is shocking and unacceptable…The video speaks for itself–she was terrified.
St. Paul Police Chief Todd Axtell responded to the incident with apparent empathy. He said in a statement:
My heart breaks when I watch this video…What we can do is apologize and take responsibility, offer support and compassion, and learn from the incident so we can continue to work to prevent it from happening to anyone else. You can't train away racist contempt.
Collins and her attorneys want to make sure the same thing doesn’t happen again to an unsuspecting citizen. Not only do they want full compensation for Collins’ pain and suffering but they want to see the dog and handler be retrained. Apparently not waiting around for a certain judgment by the courts, Police spokesperson Steve Linders confirmed Thursday that both the officer and his K9 were sent back to training, disallowed from returning to work until the month-long retraining takes place.

Slager, the white police officer whose video-recorded killing of an unarmed black motorist in North Charleston, S.C., starkly illustrated the turmoil over racial bias in American policing, was sentenced on Thursday to 20 years in prison, after the judge in the case ruled that the shooting had been a murder.
The sentence was pronounced in Federal District Court in Charleston about seven months after Mr. Slager pleaded guilty to violating the civil rights of Walter L. Scott when he shot and killed him in April 2015. It concluded one of the few cases in which a police officer has been prosecuted for an on-duty shooting.
Federal prosecutors had urged that Mr. Slager be sentenced to life in prison for a shooting that they contended amounted to second-degree murder. Mr. Slager’s defense lawyers, as well as the United States Probation Office, had recommended that the federal judge in the case, David C. Norton, treat the shooting as akin to voluntary manslaughter instead.
On Thursday, the fourth day of the sentencing proceedings, Judge Norton said he had concluded that the killing should be considered murder.
“Michael Slager admitted what he did,” Judy Scott, Mr. Scott’s mother, said outside the courthouse after the plea hearing on May 2. “That was enough years for me, because no matter how many years Michael Slager gets, it would not bring back my son.”
Mr. Slager, who has been jailed in Charleston County since he entered his guilty plea in early May.
Cell phone footage clearly shows Slager, who is white, pumping eight bullets into the retreating figure of Scott, who was black, as he fled from the officer. The distance between the two at the moment Slager began firing on the unarmed Scott appears to be anywhere from 18 to 20 feet, much too far for Scott to have been any kind of credible danger to the officer. Yet Slager falsely reported that Scott ran at him and attempted to wrestle away his Taser, causing the officer to feel "threatened" and necessitating use of lethal force.
The shooting of Scott occurred following a daytime traffic stop for a non-functioning brake light.
Immediately following the shooting, Slager radioed a dispatcher, stating, "Shots fired and the subject is down. He grabbed my Taser." In the report of the shooting filed before the video surfaced, Slager said he had feared for his life because Scott had taken his Taser,and that he shot Scott because he "felt threatened".
Bystander video proved all of this to be false. After video surfaced contradicting his police report and showing that he planted a gun by Scott's dead body, Slager was charged with murder
Despite an abundance of evidence, a state judge had declared a mistrial on December 5 after jurors failed to reach a verdict following 22 hours of deliberation. The jury was made up of 11 white jurors and one black juror. [MORE]
From [HERE] and [HERE] If not for the reporting of Jamie Kalven, an independent journalist in Chicago, the world might never have known the name Laquan McDonald, a black teenager who was shot 16 times by a police officer as he walked down a street holding a folding knife.
Mr. Kalven questioned the official police account of the shooting and revealed the existence of a police dashboard-camera video that documented the episode. Months and many court fights later, Chicago city officials were forced to release the video of the shooting, which showed Mr. McDonald, 17, being shot again and again one night in 2014, even after he lay crumpled on the street.
Three years later, Mr. Kalven finds himself forced back into the case, subpoenaed by lawyers for the police officer, Jason Van Dyke, who was charged with first-degree murder in Mr. McDonald’s death. [MORE]
Should he be forced, under oath, to reveal his sources?
That question was at the heart of a court hearing Wednesday in the case against Van Dyke. An answer to this question will have to come another day.
This is just the latest diversion from the central question of Mr. Van Dyke’s guilt or innocence, and another delay in a closely watched murder case.
Two years ago, Mr. Van Dyke was charged with murder and was released and Chicago erupted in protest. Since then, the case has slowly crawled toward resolution. Mr. Van Dyke has pleaded not guilty but no trial date has been set. The venue of the trial — whether here or in a more distant county in Illinois — is a matter of contention. And it remains to be seen whether the case will be decided in a bench trial or by a jury.
The showdown with Mr. Kalven was prompted by Mr. Van Dyke’s lawyer, who suggested that Mr. Kalven obtained leaked documents and may have passed along that information to witnesses of the shooting, influencing their accounts to investigators.
The fight over Mr. Kalven’s sources threatens to push the start of the trial even further down the road, delaying legal proceedings that many Chicagoans say should have already begun. Mr. Kalven, the founder of the Invisible Institute, a local independent news organization, said he is prepared to fight what he sees as a broadside on his First Amendment rights. In a legal filing this month, his lawyer called the effort an “unjustified fishing expedition” - because it is. [MORE]
The lawyer for Van Dyke raised eyebrows in the courtroom on Wednesday when he compared the plight of his white client to a decades-old Supreme Court case regarding the confessions of three black sharecroppers who were tortured by white police officers in Mississippi. First let's review the facts.
McDonald, 17, was killed in October 2014 when Van Dyke , shot him 16 times. Shortly before 10:00 p.m., police were called to investigate McDonald at 4100 South Pulaski Road responding to reports that he was carrying a knife and breaking into vehicles in a trucking yard at 41st Street and Kildare Avenue. When officers confronted McDonald, he used a knife with a 3-inch blade or pocket knife to slice the tire on a patrol vehicle and damage its windshield. McDonald walked away from police after numerous verbal instructions from officers to drop the knife, at which point responding officers requested Taser backup.
Video of the shooting shows that Van Dyke was advancing on McDonald, while McDonald was walking away from Van Dyke when the first shot was fired. The first shot hit McDonald, who spun and fell to the ground.As McDonald lay on the ground, still holding the knife, Van Dyke fired more shots into him. In total, Van Dyke shot MacDonald 16 times in 14–15 seconds, expending the maximum capacity of his 9mm semi-automatic firearm.Van Dyke was on the scene for less than 30 seconds before opening fire and began shooting approximately six seconds after exiting his car.The first responding officer said that he did not see the need to use force.
The initial police portrayals of the incident, consisting of about 400 pages of typed and handwritten reports,prompted police supervisors to rule the case a justifiable homicide and within the bounds of the department's use of force guidelines. The reports did not say how many times McDonald was shot and said McDonald was acting "crazed" and lunged at officers after refusing to drop his knife.Michael D. Robbins, one of the attorneys representing the McDonald estate, said his initial thoughts were that “I didn’t think there was a case if he had lunged at a police officer,” adding, "The police narrative, without exception, is that the use of force is justified and necessary, which it sometimes is.
One police report described that McDonald "raised the knife across chest" and pointed it at Van Dyke. Van Dyke told investigators that he feared McDonald would rush him with the knife or throw it at him, and he also recalled a 2012 Police Department bulletin warning about a knife that was also capable of firing a bullet, as well as throwing knives and also spring-loaded knives capable of propelling the blade.One report noted that McDonald's knife "was in the open position" but, when announcing charges against Van Dyke, Cook County State's Attorney Anita Alvarez said the knife was found folded at the scene.
Kalven and other reporters noted inconsistencies between the narrative police told reporters, the autopsy, and an anonymous eye-witness account before the video was publicly released. A whistle-blower expressed concern over the handling of the McDonald shooting a few weeks after the shooting, revealing "that there was a video and that it was horrific," to Kalven and attorney Craig Futterman.The pair issued a statement calling on Chicago police to release the dash-cam video of the incident.The city of Chicago denied at least 15 requests for its release. Klaven's article, “Sixteen Shots,” which appeared in Slate in February 2015, forced the case out of obscurity.

The votes fell largely along partisan lines with most Democrats voting against the bill and Republicans voting in favor, although six Democrats voted in favor of the bill while 14 Republicans voted against it. Called "the Concealed Carry Reciprocity Act," the bill was proposed by Doug Collins of Georgia in January and sponsored by Richard Hudson of North Carolina and amends Title 18 of the US Code, "to provide a means by which nonresidents of a State whose residents may carry concealed firearms may also do so in the State." One of the most significant battles ahead, Sanders and Warren note, will be over Republican efforts to pivot from “tax reform” to the pursuit of devastating cuts to safety net programs that low-income and middle-class families rely upon to put food on the table and afford life-saving medical care.
“Literally minutes after they passed this disastrous [tax] bill in the Senate, the discussion escalates. Of course they’re going to cut Social Security, Medicare, and Medicaid,” Sanders said. “And you know why? This is shocking: the deficit is too big.”
“That’s right,” Warren added, calling the Republican tax plan a “pay off” to right-wing billionaire donors. “They want to run up the deficit and then say a high debt is the reason they’ve gotta cut all the things for working people.”
This GOP plot to use the deficit created by their own legislation to justify deep cuts to social programs is hardly a secret. As the Washington Post‘s Jeff Stein reported on Wednesday, Republicans are discussing their plans openly and proudly.
“President Trump and top Republican officials have signaled prioritizing welfare cuts, including new restrictions on who can receive benefits like food stamps, housing assistance, and direct cash welfare for the poor,” Stein notes, quoting several Republican lawmakers who seem giddy at the prospect of “welfare reform.”
