From [SFGate] California has not executed a prisoner since 2006, but a legal scholar who opposes the death penalty says a recent state ballot measure and U.S. Supreme Court rulings could doom as many as 20 inmates who have run out of appeals.

With the passage last year of Proposition 66, which eliminated regulatory review of the state’s new one-drug execution procedures, “I think there’s going to be a wave of executions,” Erwin Chemerinsky, dean of the UC Berkeley Law School, said Tuesday in a meeting with The Chronicle’s editorial board.

Out of 746 condemned inmates in California — the largest Death Row in the country — at least 20 have lost all legal challenges and now are contesting only the state’s method of execution. Their case is before U.S. District Judge Richard Seeborg of San Francisco, who must decide whether the state’s procedures and proposed drugs, some of them untested in executions, pose an undue risk of a prolonged and agonizing death.

Another federal judge halted California executions in 2006, finding flaws in lethal injection procedures and staff training. The state has rewritten its rules several times since then, switching from a three-drug combination to a fatal dose of a single barbiturate after manufacturers withdrew other lethal drugs from the market, but has not yet won court approval.

Donna Brazile: "I considered replacing Clinton with Biden as 2016 Democratic nominee." [MORE] Brazile is a member of the Democratic Party, briefly serving as the interim chairperson for the Democratic National Committee in spring 2011, and assumed that role again in July 2016, until February 2017.

She was the first African American to direct a major presidential campaign, acting as campaign manager for Al Gore in 2000. She has also worked on several presidential campaigns for Democratic candidates, including Jesse Jackson and Walter Mondale–Geraldine Ferraro in 1984, and for Dick Gephardt in the 1988 Democratic primary. [MORE] Her actual role in any of said campaigns is a mystery and all were losing efforts. Was she a "straw boss?"

So, Donna Brazile had her fingers on the nuclear buttons while HRC was up in the polls by 20 -30 points? This is the stuff of childish fantasy from a mind controlled victim of racism/white supremacy. About as fantastically unrealistic as the NAACP demanding that NFL commissioner Roger Godell meet with him or else over Kaepernick! Beggars cannot make demands in real life. Racist suspects at the DLC put Brazille in charge of the DNC to create false appearances. Her token representation, a necessary illusion to to give the appearance that Blacks and Latinos have a meaningful role and act as valued participants and major "players" within the Democratic Party. Brazile was in charge of elite whites at the DNC and HRC valued the advice of a Black woman who also functioned as her "close advisor" is fantasy that Black voters want to believe. This propaganda is in line with the programming on television which depict relations between Blacks & whites in various contexts as symbiotic, equal or arms lengths interactions. Brazile served a purpose for the DNC but not the one she believes she served.

Like most of the Black electorate, Brazile wanted to be deceived by Democrats. This is not to to say that Brazile is not intelligent or that her advocacy is not genuine [This is digression and distraction from an actual, ongoing hoax that the GOP dissapeared nearly a million of non-white votes through the Interstate Crosscheck program. It is demonstratably clear that Dem leadership has no real interest in the substantive rights of Blacks - but now we can also easily see the procedural rights of Blacks, such as voting or pretending to vote, are not even taken seriously. In the face of mounting evidence Dem leadership has done nothing to enforce the "voting rights" of Blacks & Latinos). It just means she is a self deluded victim of racism/white supremacy. Belief in racism/white supremacy is making Black people deluded, crazy and mentacidal. 

Neely Fuller explains, "in a socio-material system dominated by Racism (White Supremacy) many non-white people like to pretend they are in charge, and/or that, it is they who make the final decisions of major matters. Since they do not, it is incorrect for those to pretend they do." 

Racism/white supremacy is carried out primarily through deception; many, many lies and false appearances presented by racists for non-whites to consume. It is designed to subjugate non-whites through the masterful promotion of falsehood. 

Fuller states, "non-whites are not smart or sophisticated in their attempts to prevent being subjugated by White Supremacists. They are usually easily fascinated, deceived and victimized by any white person who believes in and knows how, to practise Racism."  

"Whatever a Black person gets, and/or is allowed to keep, is the result of decisions made by White Supremacists. This is the functional meaning of White Supremacy (Racism) that many people — particularly non-white people — prefer not to acknowledge.  It is correct for all non-white persons to know and understand these things to be true, and to stop pretending that they are not. Non-white people should stop pretending that they have power that they do not have." [MORE]

'Whatever happened or did not happen at the DNC last summer was probably the result of white supremacists/racists as they control everything in all areas of people activity (economics, education, entertainment, labour, law, politics, religion, sex and war) - 24/7 worldwide.'

Although the GOP is "the white party" which functions solely as a racist "racial identity" party for whites (the GOP now depends on white votes for 90% of all their votes in presidential elections), the Democratic Party is also a white party - run & controlled by racist suspect elite whites in the DLC. Maintaining the illusion that Blacks and Latinos are important decision makers within the Democractic Party is necessary, as 71% of Latinos, 93% of Blacks, 84% of Native Americans, 73% of Asian Americans but only 39% of white people vote Democrat. Brazille was showcased by racist suspects to maintain our belief - which is part of a much larger deception. 

Amos Wilson explains, 'politicians and the media strive strenuously to convince the Black votary that every conceivable problem which confronts it can be resolved through voting heavily for Black and friendly White politicians. The establishment is ever quick to remind the Black electorate of the historical struggles necessary to achieve their right to vote. It indicts the community for any perceived electoral apathy and seeks to evoke guilt feelings in those who do not participate in the electoral process — making such ritualistic participation emblematic of democracy and first-class citizenship.

This is of special interest when it is realized that very few of the major political, economic and social goals achieved by Black America, including the Voting Rights Act, were accomplished through Black voting prowess. The ballot box has been a relatively impotent weapon in the achievement of major victories by the Black community. Suddenly vigorous protest and direct-action legal suits and extralegal processes such as boycotts, sit-ins, and the like, which were used so effectively by the community to achieve its socio political ends and to fight injustice and oppression, have fallen far behind the election of Black and friendly White politicians to achieve the same ends. Politicians who in no way are interested in developing a program for the economic emancipation and empowerment of the Black community, and who are not committed to neutralizing White supremacy.' What tangible positive gains will follow? 

It is painful to recognize the powerless reality that Blacks face - but you have to begin somewhere.

Ed Gillespie Final Campaign Push Plays on White People's Hatred of [All] Blacks Protesting in the NFL

From [ThinkProgress] Many sports fans often beg for their favorite athletes and sports reporters to “stick to sports” and to keep politics and sports separate. But these days, it seems to be politicians who are the most adamant about tying the two topics together.

Weeks after President Donald Trump ignited a firestorm by arguing for the NFL to fire any player who protested systemic racism by taking a knee during the national anthem, Republican Ed Gillespie is trying to use his base’s hatred of the protesting players to make a last-minute push for votes in the hotly-contested Virginia governor’s race.

“You’d never take a knee… so take a stand on election day,” the Ed Gillespie for Governor flyer reads.

Gillespie has leaned heavily on the culture wars in his campaign against Democrat Ralph Northam.

Last month, Gillespie said that he would ban sanctuary cities, even though Virginia currently doesn’t have any. In an ad, he tied the non-existent sanctuary cities to the threat of gang violence, and juxtaposed the words “Kill. Rape. Control” over the faces of Latino men.

“Ralph Northam cast the deciding vote in favor of sanctuary cities that let dangerous illegal immigrants back on the street, increasing the threat of gangs like MS-13,” the ad stated. “We have to ban sanctuary cities and deport dangerous illegal immigrants who commit crimes, starting with ruthless MS-13 gang members.”

Gillespie has also said that he wants to preserve the state’s Confederate monuments — a fact that certainly delights racist moron Trump.

Therefore, it shouldn’t really be a surprise that Gillespie — a former counselor to President George W. Bush, Republican National Committee chairman, and long-time Washington lobbyist — would try to exploit the hatred of NFL protesters in the campaign’s final days. After all, the vast majority of the NFL players who are protesting are black, and much of the criticism surrounding the protests has been incredibly racist, so this fits right in with the racist dog-whistles Gillespie has been sending out throughout the campaign. Fuck a Fine. From [Jurist] The US Department of Justice, the Environmental Protection Agency and Louisiana Department of Environmental Quality (LDEQ) [official websites] reached a settlement agreement [text, PDF] with ExxonMobil [corporate website] Tuesday over violations of the Clean Air Act from their chemical, olefins, polymer and plastics manufacturing facilities located in or near Baytown, Texas, Beaumont, Texas, Baton Rouge, Louisiana, and Mont Belvieu, Texas.

ExxonMobil will be required to pay a civil penalty of $2.5 million, $470,00 of which will go to the LDEQ and the remainder to the US and to pay for air pollution reduction measures. ExxonMobil will also be required to invest in the installation and operation of air pollution control and monitoring devices at 26 industrial flares located at five facilities in Texas and three facilities in Louisiana, which is expected to cost about $300 million.

ExxonMobil will also be required to spend at least $2,572,000 various Federal Supplemental Environmental Projects and State Beneficial Environmental Projects. This includes planting 1,458 trees in the city of Baytown, Texas, providing upgrades to LDEQ stationary ambient monitoring stations, and providing the LDEQ with a $1.5 million mobile air monitoring laboratory.

The settlement will be subject to a 30-day public comment period and will then need final court approval before being enacted.

Deadly pollutants that can cause both short-term respiratory and memory problems, as well as permanent damage to the heart, brain, lungs or cause cancer and damage to the liver, kidney, and central nervous system. Although Racist Suspect Prosecutor Engaged in "Unsavory" Misconduct Court Will Allow Alabama to Murder Black Man

From [DPIC] Finding that a racist suspect Alabama prosecutor with a history of misconduct had "intentionally" made improper comments in the capital trial of Artez Hammonds "in flagrant violation" of a pre-trial order warning him not to do so, the U.S. Court of Appeals for the Eleventh Circuit nevertheless denied Hammonds's appeal and permitted his conviction and death sentence to stand. 

While the court noted that the prosecutor, District Attorney Douglas Valeska [in photo] "had been reprimanded in prior cases for engaging in precisely the same unconstitutional and unethical behavior" and said it was "very disturbed" by the prosecutor's deliberate unconstitutional references to Hammonds's decision not to testify and to his prior incarceration, the court ultimately held that the comments did not affect the jury's verdict and denied him relief.

While in prison for an unrelated offense, Hammonds was tried, convicted, and sentenced to death in Houston County in 1997 for the rape and murder of a white woman in a high-profile case that had gone unsolved for six years. 

Despite a population of only 100,000, the county currently has 18 people on its death row. As of January 1, 2013, its death row ranked 30th in size among all counties in the United States, even though it was less than one-quarter the size of any other county in the top thirty, and two-thirds of those counties had populations of more than one million.

Valeska served as Houston County's district attorney for three decades until his retirement in January 2017, obtaining more than a dozen death sentences during that period. A study by the Equal Justice Initiative in May of 2008 reported a 16-fold increase in the number of death sentences in Houston County between 1995 and 2008, while Valeska was in office, over the death sentences imposed in the previous two decades. During his time in office, Valeska was found to have violated the rights of capital defendants on numerous occasions by unconstitutionally striking African Americans from death penalty juries because of their race and making improper inflammatory comments during trial. Because of this history, Hammonds's trial lawyer specifically requested the court, before the trial started, to order Valeska to refrain from commenting on Hammonds's decision to exercise his Fifth Amendment right not to testify.

But, as the Eleventh Circuit wrote, "neither the Constitution nor a direct order from the court inhibited Valeska" from improperly commenting on Hammonds's choice not to testify. The court critcized the Alabama Attorney General's office, which represented the state during the appeal, for "perpetuat[ing] the charade that Valeska did not intend" to violate Hammonds's rights, saying that the state attorney's "insistence on defending this improper conduct implicitly condones the unethical tactics that Valeska used" and invites other prosecutors to engage in similar "unsavory conduct." The court provided a copy of its opinion to the Alabama State Bar to review Valeska's conduct for possible disciplinary action.

Since 2014 Incompetent ICE Race Soldiers Have Lost at Least 228 Guns, Some Were Used to Commit Serious Crimes

From [TechDirt] Between fiscal years 2014 and 2016, the Department of Homeland Security personnel lost a total of 2,142 highly sensitive assets — 228 firearms; 1,889 badges; and 25 secure immigration stamps.

That's from the latest Inspector General's report [PDF] on DHS components' ability to secure items that might wreak havoc -- ranging from inappropriate access to multiple deaths -- if left improperly secured. This includes current presidential faves CBP and ICE -- both DHS components.

The bad news is it's good news:

Although this represents a slight improvement from our last audit, more than half of the lost items we reviewed (65 of 115) revealed that component personnel did not follow policy or used poor judgment when safeguarding these assets.

The IG should probably not expect more year-to-year improvements, no matter how slight.

In these cases, components did not always hold personnel accountable nor did they receive remedial training for failing to safeguard these sensitive assets.

And I'm not kidding about loose components causing death. The report points to a 2015 robbery where something ICE didn't secure led to exactly this.

Even with new controls designed to strengthen the security of sensitive assets, lost or stolen Federal firearms continue to be used to commit serious crimes. For instance, a media article reported a September 2015 robbery in which an attacker killed a man with an Immigration and Customs Enforcement (ICE) firearm that was stolen from an unattended vehicle. The ICE agent failed to properly secure the weapon inside the vehicle in a high crime area.

ICE in particular seems particularly careless with firearms.

Two off duty ICE officers left their firearms unsecured and unattended in backpacks while on a beach in Puerto Rico. When the officers returned the bags were gone.

An ICE officer left his firearm, badge, and credential unsecured in his hotel room while on vacation. As he slept, his overnight guest stole his belongings.

Trump Approves Test Program to Expand Government & Commercial Use of Domestic Drones

From [CBS] Americans could see a lot more drones flying around their communities as the result of a Trump administration test program to increase government and commercial use of the unmanned aircraft. 

President Trump gave the go-ahead Wednesday, signing a directive intended to increase the number and complexity of drone flights. 

The presidential memo would allow exemptions from current safety rules so communities could move ahead with testing of drone operations. 

States, communities and tribes selected to participate would devise their own trial programs in partnership with government and industry drone users. The administration anticipates approving at least five applications, but there is no limit on the number of communities that can join. 

The Federal Aviation Administration would review each program. The agency would grant waivers, if necessary, to rules that now restrict drone operations. Examples include prohibitions on flights over people, nighttime flights and flights beyond the line of sight of the drone operator.

Despite Low Crime Rate, DC adds More Cops to Calm Delusional Whites & Justify Their Original, Ongoing Crime

Vanilla City Needs a Snickers. From [WashPost] The D.C. police department now has more than 3,800 officers, an increase from the previous year when the size of the force fell below that mark for the first time in a decade, prompting concern from city leaders over the thinning ranks.

Racist suspect Police Chief Peter Newsham [in photo] told Mayor Muriel E. Bowser (D) and council members Tuesday that fewer officers are leaving each month, an indication that the force is stabilizing after years of failing to keep pace with attrition.

“I feel comfortable with the size of the force right now,” Newsham said during the breakfast meeting at the John A. Wilson Building, where he outlined several incentive programs designed to attract and keep officers.

As of Oct. 1, the start of fiscal 2018, the police force had 3,821 sworn members, an increase of 84 from the previous year. That number includes 71 hires of “senior sergeants” and “senior detectives” — retired officers who have been allowed to return under an emergency measure that ends next year. The added time does not affect their pension benefits.

Sgt. Matthew Mahl, chairman of the D.C. police labor union, said the District is not yet in the clear.

“I think we’re still desperately short,” Mahl said, adding that he thinks the department needs an additional 100 to 200 officers. “What’s required of us is more than the manpower we have. I think patrol officers and detectives are the hardest hit. I think they operate on a bare minimum on a daily basis.” [MORE]

Preliminary analysis of crime data from the nation’s 30 largest cities released by the Brennan Center for Justice on Wednesday suggests that crime is not on the rise at all. In fact, according to the center’s overview of crime and murder data, 2017 is on pace to have the second-lowest violent crime rate of any year since 1990.

From the report:

• The overall crime rate is projected to drop by 1.8 percent to the second-lowest point since 1990.
• The violent crime rate is projected to fall by 0.6 percent, also to the second-lowest point in over 25 years. (The lowest rate was in 2014.) “This result,” the report’s authors write, “is driven primarily by stabilization in Chicago and declines in Washington, D.C., two large cities that experienced increases in violence in recent years.”
• The murder rate is projected to be down 2.5 percent, on-par with the rate in 2009

With Crime Low, Houston "Police" Look For Any Pretext to Obtain Military Hardware, Such as Hurricane Relief

From [MintPress] HOUSTON – In the wake of Hurricane Harvey, local Texas police are using the recovery efforts to justify the continued existence of a controversial program that critics argue strongly contributes to a dangerous trend of police militarization. According to the Houston Chronicle, local police agencies are arguing that excess military equipment they had received from the Pentagon through its controversial “1033” program allowed them to rescue people in areas they could not have reached otherwise. Federal data cited by the Chronicle showed that the greater Houston area has received more than $13 million in military equipment via the program since 2014.

“They tend to think that we’re militarizing ourselves. No, we’re not,” Sgt. Jimmie Cook of the Harris County Sheriff’s Office told the Chronicle. “We’re not looking for M16s. It’s useful gear that helps supplement our budget and it doesn’t cost the county anything except for the tank of gas to go pick it up.”

While the Chronicle piece on the matter paints an overall rosy picture of how heavy military equipment is being used by Houston-area police – as well as its role in flood rescues — it also admits that much of the military equipment ended up not being used in flood rescues after all. The article notes that certain classes of military-grade vehicles were rendered ineffective for work in flood situations due to concerns about electrical wiring or due to department concerns that the vehicles could suffer damage that would render them useless in the future.

The article does not mention that non-military equipment and vehicles designed for use in flood zones could have been equally, if not more, effective in post-Harvey rescues. It also failed to explain how heavy weapons such as grenade launchers, body armor and powerful military-grade rifles – a larger portion of the items departments received than were the vehicles used in flood rescues – contribute to disaster-relief, as opposed to simply furthering the militarization of local police.

Despite the fact that war-zone vehicles and equipment were not necessarily as effective as local law enforcement suggested, a number of local departments are now clamoring to increase their stock of military-grade assets in Harvey’s wake. This, along with the positive tone in which the Chronicle article portrayed the program, caused critics to assert that the Harvey pretext is being used to justify a program that the  ACLU has argued pushes police to “wage war in our neighborhoods.”

Professors from Harvard, Stanford Confirm Massive Vote Thievery by Trump, GOP of Black & Latino Votes in Hoax [s]Election

Greg Palast explains, Profs finally back up what I’ve been screaming for years. The Kobach-Trump Crosscheck program is the Alt-Right Godzilla of voter suppression. 

"We find that one of Crosscheck's proposed purging strategies would eliminate about 300 registrations used to cast a seemingly legitimate vote for every one registration used to cast a double vote."

And even that 1 in 300, say the profs from Stanford, Harvard, Penn, Yale and Microsoft, is probably just clerical error. 

 In their quiet academic way, the profs are effectively proving a massive crime wave of vote thievery the GOP has aimed at "common names" — i.e. Hernandez, Washington, Kim —voters of color (see study). And the color is Blue. Wake up, Dummycrats, it ain’t the Russians.

Collusion is not a crime by itself. But Mueller May Charge Conspiracy to Defraud the US by Interfering w/Election

From [WashPost] Special counsel Robert S. Mueller III fired his opening salvo this week, unsealing charges against three former Trump campaign aides thought to have engaged in a medley of wrongdoing.

The cases he revealed, legal analysts said, indicate he is pursuing an extensive probe that will explore both personal wrongdoing of those connected with President Trump and possible efforts campaign officials took to work with Russia to influence the 2016 election.

Collusion — the word Trump often uses to describe Mueller’s case, even as he asserts such a thing never happened — is not itself a crime, and Mueller’s team will probably have to sort through unseemly political dealings to determine whether a law was broken, legal analysts said. In his first public charges, though, Mueller offered a hint of the direction he might take.
